I would imagine the theme from 3.x not being compatible. Someone might be able to comment better than I can on this. Not a big theme expert myself.
However, the fluid layout is not a feature of the theme itself. There is an option, which may now be enabled by default, called "Fixed width" to make the layout not fluid. Just search for it in the administration panels using the configuration search.
