Yeah, some people are affected by a bug here and others aren't. I'm not sure why. Anyway, if your site host doesn't correct the upgrade error, you can follow the steps outlined on http://themes.tikiwiki.org/How+To+Add+a+New+Theme except you'll need to delete existing files of the affected theme before uploading the new files, which you'll need to get from the Tiki 4.1 package.
